The security practices of this policy apply to services offered by MOFA accessible under the domain and sub-domains of www.digitalmofa.com/ and the Digital mofa app available at Apple Store and Google Play. By accessing this site and apps, the End User consents to be bound by the terms and provisions of this Privacy Policy (End-User(s) that do not agree should not access or use the site or mobile app).

 

This Privacy Policy outlines the data, as a major aspect of the ordinary operation of MOFA services., It addresses the data gathered from the End User and what may happen to that data. MOFA is providing Privacy Policy information so that End Users can make educated choices in the use of the web presence and offerings.

 

By agreeing to the Privacy Policy, End User agrees to MOFA utilization and revelation of End User personal data as stated in this policy – without any additional condition(s). This Privacy Policy incorporates MOFA’s Terms of Service (ToS) and Authorized Use Policy (AUP). Also, it incorporates by reference any agreements mentioned in the ToS and AUP. This Privacy Policy is binding when an End User agrees to them. The Privacy Policy is effective on March 24th, 2022 for all clients.

 

As a condition of the use of this site and mobile apps, MOFA wishes to advise its immediate and potential clients of the terms and conditions surrounding the capture of Internet Protocol (IP) addresses and record of the type of device being used and device ID. End-User IP address, which is the internet address of End User computer/device along with browser type and operating system, are collected to help identify the geographical distribution of visitors to MOFA web presence and the means by which they are accessed. MOFA holds its visitors and customers in high regard. The information collected will not be sold or misused. We also collect the device ID to identify the device uniquely.

  • DEFINITIONS

Personally Identifiable Information” (PII) includes information which, either alone or in combination with other information we hold about an End User, identifies the End User as an individual, including, for example, name, postal address, email address and telephone number

 

Anonymous Data” means data that is not associated with or linked to PII and that does not permit the identification of individual persons, either alone or when combined with any other information available to a third party

  • NOTICE OF AUTHORITY AND COMPLIANCE

Payment Card Industry (PCI) Compliance – MOFA uses the Stripe payment gateway (https://stripe.com/) which is certified with PCI Data Security Standards (DSS), published by the PCI Security Council (www.pcisecuritystandards.org) when processing credit card transactions and any others within its scope.

 

  • PERSONALLY IDENTIFIABLE INFORMATION (PII) AND COLLECTION

MOFA’s basic role in gathering data is to give End Users a protected, secure online application for transmitting and signing contracts. MOFA gathers data to recognize clients and to maintain individual client identity. Data gathering is done where MOFA determines it is vital to meeting client requirements and in compliance with applicable law, regulation and policy. Some of the personally identifiable information we collect include:

  • Name
  • Email Address
  • Address
  • Contact Number
  • Passport number

Other information that can be collected to allow recognition of clients and to maintain individual client identity.  include:

  • DOB
  • Country of birth
  • Gender
  • Company Details
  • Agency Details

Publicly available content from the MOFA web presence may be browsed anonymously before an End User agrees to use it. When an End User provides Personally Identifiable Information the End User is known to MOFA. By agreeing to use MOFA offerings the End User may be required to disclose contact and personal data, billing and shipping information and other data as shown on the forms throughout our Site. Where conceivable, MOFA demonstrates which fields are required and which fields are discretionary. End-User generally has a choice to not give data by opting not to utilize a specific service or facility on the site.

We also gather supporting documents such as passport, ID and other documents (to verify the identity of the applicant by the Ministry of Foreign Affairs

For certain offerings, additional data may be required from the End User to validate the use of certain products/services, including but not limited to name, location, or last 4 digits of the End User social security number. MOFA might additionally utilize financial data, including credit card data, to confirm the accuracy of the End User name, location, and other data, and to charge the End User for the utilization of products/services. MOFA will not knowingly share the data in a way that affects End User credit scoring.

  • Financial Data 

MOFA does not store financial information, such as data related to your payment method (e.g. valid credit card number, card brand,) that we may collect when you pay for the services in the MOFA app. We store only very limited, if any, financial information that we collect such as the last 4 digits and the expiration date of the credit card. Otherwise, all financial information is stored by our payment processor.

  • USE OF YOUR INFORMATION

Having accurate information about you permits us to provide you with a smooth, efficient, and customized experience. Specifically, we may use information collected about you via the Digital MOFA application to:

  • Assist law enforcement and respond to subpoena.
  • Compile anonymous statistical data and analysis for use internally or with third parties.
  • Create and manage your account.
  • Deliver targeted newsletters, and other information regarding our services and the application to you.
  • Email you regarding your account or document processing.
  • Enable user-to-user communications.
  • Fulfill and manage payments, and other transactions related to the digital MOFA application.
  • Generate a personal profile about you to make future visits to the Digital MOFA more personalized.
  • Increase the efficiency and operation of the Digital MOFA.
  • Monitor and analyze usage and trends to improve your experience with the Application.
  • Notify you of updates to the app.
  • Offer new products, services, mobile applications, and/or recommendations to you.
  • Prevent fraudulent transactions, monitor against theft, and protect against criminal activity.
  • Process payments and refunds.
  • Request feedback and contact you about your use of the Digital MOFA.
  • Resolve disputes and troubleshoot problems.
  • Solicit support for the app.

DISCLOSURE OF YOUR INFORMATION

  • Use of Cookies

In order to effectively analyze the flow of MOFA web pages and ensure trust and safety in the use of the site, information-gathering techniques such as “cookies” may be utilized. “Cookies” are little records put on the End User computer’s hard drive that support MOFA services provision. The data in “cookies” are not connected to any generally identifiable data End User may submit while on our site. MOFA offers certain features that can only be utilized via “cookies.”

Similarly, MOFA utilizes “cookies” to permit End User to reduce the number of times required to enter End User password during a session on the site. It is important to note that most “cookies” are “session cookies,” which means that they are temporary and are immediately erased from the End User computer’s hard drive at the end of the End User session on the site. End-User(s) are given the right to disallow “cookies” if the End User browser facilitates this. If this happens, then the End User may not be able to utilize certain features on our site. It may also become compulsory for the End User to re-enter the End User password more frequently during a session.

 

Please note that MOFA software, installed on the End User computer in order to send or receive documents for signature, is also governed by this Privacy Policy.

 

In the event the End User creates a credit account to pay the fees that MOFA charges, we will collect some additional information, such as a billing address, a credit card number, and its expiration date.

 

If the End User uses MOFA to send or receive documents, the documents will be encrypted and stored in an account. The contents will be available only to those whom the End User invites to view or to sign. MOFA employees do not have access to this information, nor can they access the End User video/signature file or other data, stored in the system.

 

In the administration of services, if the End User sends personal correspondence (e.g., emails, requests for demos or letters) MOFA may collect information into a file specific to the End User. The information may include End User name, email address and phone number, etc.

  • Personally Identifiable Information Use

Our Disclosure of End User Personal Information – As a general policy, MOFA does not rent, share or sell any of End User personal data to third parties other than as provided in this Privacy Policy. MOFA may use

Internal Service Providers for Our Operations: We may utilize third parties, referred to as internal service providers to whom we may outsource one or more aspects of our business processes. If MOFA elects to use third-party service providers then those entities, and their use of End User data, will be included within the scope of this Privacy Policy.

 

  • Accessing, Reviewing and Changing End User Personal Information

MOFA allows End-User to automatically access and modify any information End User submits by logging into the site and inputting new details. All users can change their password, contact and financial information and their user preferences by accessing the designated user profile area of the site. End-User must promptly update End User personal information if it is inaccurate or no longer relevant. Please note that changing End User personal data will not impact any previously completed transactions. MOFA will not alter End User personal information, even if a request is received. Having End User, as the only account information editor, maintains the integrity of the End User account.

  • Deactivation and deletion

Upon End User-written request, MOFA will deactivate the End User account, contact information, billing information, shipping information, and financial information from our active databases. To make this request, email [email protected]. Such information will be deactivated as soon as reasonably possible based on End User account activity and in accordance with our deactivation policy and applicable laws.

 

To prevent fraud, collect any fees owed, resolve disagreements, troubleshoot issues, assist with any investigations, enforce our User Agreement and comply with legal requirements as is permitted by law, some personal information, and past document transactions will be retained in our files. Therefore, users should not expect that all their personal information will be completely removed from our databases in response to their requests. Note, however, that while the information will be deactivated from normal Subscriber viewing, it will remain available to selected MOFA personnel as a part of our normal business operations.

 

As per our Subscription Agreement, if you deactivate your MOFA account, your backups will be queued for deletion as provided for by the law.

Upon the effective date of termination as stipulated by the law, we shall have no obligation to maintain or provide any of Your Data and shall thereafter, unless legally prohibited, delete all of Your Data in Our systems or otherwise in Our possession or under Our control.

  • Third-Party Sites

End-users are aware that any third-party links and features are provided as a convenience. End-user understands that separate terms and conditions apply to third-party offerings. The third-party and end-user shall reach a separate agreement. MOFA is not a party. End-user is solely responsible for reading and considering any third-party agreement, before executing.

  • Security

End-User data is securely stored on MOFA’s servers situated in the USA and Ethiopia . We utilize standard procedures to secure End User personal data against theft or loss and from unapproved access and disclosure to safeguard End User privacy with the use of encryption, “firewalls” and Secure Socket Layers. MOFA treats information as an advantage that must be secured against misfortune and unapproved access. Security methods are utilized to ensure such information is protected from unapproved sources both inside and outside of our organization. Perfect security is not possible. MOFA does take good faith effort(s) to provide appropriate security – in full compliance with applicable law, regulation and policy.   • Retention

MOFA will only retain end-user information for as long as is reasonably necessary to deliver the product, service, content or capability agreed. This retention is subject to the compliance exceptions stated in this agreement.

POLICY FOR CHILDREN

Information About Any Use by Children

MOFA services are not meant for children and we don’t direct them to anyone under the age of 18. Therefore, we do not knowingly solicit information from or market to children under the age of 18. If you become aware of any data we have collected from children under age 18, please contact us using the contact information provided below.

MOFA does not knowingly collect, maintain or use personal data from children under 18 years of age. Details related to children/teenagers who are under 18 years of age, should be entered by their parents or guardians on their behalf. By entering the relevant information of their children, they acknowledge that the appropriate consent is given to save the said data.

If an end-user learns that a child has provided information without appropriate consent of their parents, alert MOFA via email: [email protected] so that we may delete the information and take any other appropriate corrective measures.

  • International Data Transfer

If you are a non-Ethiopian. user of MOFA offerings, you acknowledge and agree that your personal data will be processed as stated in this agreement

  • End-User Rights

We reserve the right to amend this Privacy Policy at any time by posting the amended terms on our site.
